Liability against damage protection
Damage protection answers the question of who pays when a guest breaks your property. Liability protection answers the opposite question: whether you are responsible when someone is hurt in it, or their belongings are damaged. Money moves in different directions and different people decide.
Filing an injury through the damage process is the most common error here, and it produces a refusal on the wrong grounds that then complicates the correct route. The two halves are set out together in host damage protection and in the Airbnb damage policy guide.
It is triggered by fault, not by accident
Guests are injured in perfectly maintained properties, and hosts are not automatically responsible when they are. Liability generally attaches where a hazard existed, the host knew or should have known about it, and nothing was done to fix or warn about it. A guest tripping over their own luggage is not the same as a guest tripping on a stair tread reported by three previous guests.
That distinction is why the useful evidence is historical. A dated log of inspections, repairs and checks tells a story of reasonable care that no post-accident photograph can. A guest got injured at your Airbnb covers the first 24 hours in full.
Where it stops
It responds to guest injury and guest property damage connected to a platform stay. It is not property insurance for your building and contents, it does not reach a direct booking taken through your own site, and intentional acts sit outside it. A judgment larger than the limit is also your problem.
Those edges are where hosts discover they were underinsured. Umbrella insurance for Airbnb hosts covers the layer that sits above the limit, and short-term rental insurance providers compared covers the policies that carry the risk on non-platform nights.
The amenities that generate the claims
Serious injury claims cluster around a small set of features: stairs, pools, hot tubs, balconies and decks, fire pits and barbecues, and anything involving hot water. These deserve a documented inspection cadence of their own rather than a general glance during a turnover.
If an amenity is genuinely risky and you are not willing to maintain it on a schedule, removing it is a legitimate liability decision. Airbnb amenity liability works through hot tubs, pools, barbecues and stairs individually, including disclosure and signage.
What to do in the first day
Deal with the injury first, then document the scene before anything is repaired, report it through the platform the same day, and notify your own insurer even if you expect the platform programme to respond, because late notice is a common reason cover is refused.
Do not put an apology that reads as an admission of fault in writing. Empathy is fine; accepting blame is a sentence that will be read back to you. Keep the factual record, including the maintenance history for the area involved.
